Dear Experts. in GST regime ITC can be claimed by buyer after payment of tax & filing return thereof by supplier.
my query is :- assume if i have purchased the Goods Rs. 100 Gross value 28% GST total 128/- so at the time of Filing return i need to avail credit of 28 GST. However as per GST provision credit of 28 can be avail after its payment & return filed by supplier. pls let me How i will know that the supplier has already paid Rs. 28 GST also had filed return for the same.

This is a pinpoint provision which will definitely affect dealers the only solution of this problem is to be in regular touch with your dealer.

sir. in this case A supplier may lie so how we will sure that the supplier has paid actual Tax & filed return.

The Return filing is so planned that, the supplier will provide the details of his sale in GSTR 1 on or before 10th of subsequent month, So if your GSTN no. is provided by him in his GSTR 1, then your Auto populated GSTR 2 will show that credit on or before 15th, so you can get the credit.

I completely agree with you mr dibin that when supplier filed his GSTR-1, credit is automatically transferred to our credit ledger and reflect in auto-populated GSTR-2 but the main problem is that in GST our tax credit depends on supplier if he is not depositing tax to government or not filing return then credit claimed in GSTR-2 will be recovered from the person who avails credit and yes supplier may lie, and currently no clarification is there on this issue from department.
