Obviously, the retail shop owner won't be giving you TDS certificate, as he has defaulted in deducting TDS. Ask him to give a certificate on a letter head, duly stamped and signed. On that basis you can file your return. Any deductions can be claimed if you have proof of payment.

If as per above expert advice Mr X return is filed with support of certification on letter head of retail employer then is there could be any problem for employer for non deduction of tax
