02 September 2015 thank u sir but i want to know whether it will be laible for capital gain tax or exempted as per the details given

01 August 2024 Under Indian tax laws, the sale of agricultural land may or may not be subject to capital gains tax, depending on certain factors. Let’s break down the criteria to determine if the sale proceeds of your agricultural land will be liable for capital gains tax or exempted:

### **Criteria for Exemption from Capital Gains Tax on Agricultural Land:**

1. **Location of the Agricultural Land:**
- **Urban vs. Rural:** Agricultural land located in rural areas is generally exempt from capital gains tax. However, agricultural land in urban areas is subject to capital gains tax.
- **Definition of Rural Area:** For income tax purposes, the definition of rural and urban areas is defined by the Income Tax Act. Land is considered rural if it is situated outside the limits of a municipality or municipal corporation and does not fall within the jurisdiction of an urban area as defined by the respective state government.

2. **Distance from the Municipality/Municipal Corporation:**
- Land located in a rural area and outside the limits of any municipality or municipal corporation is typically exempt from capital gains tax. However, proximity to urban centers or changes in population density can affect this classification.

3. **Population of the Village:**
- **Population Threshold:** For rural areas to be considered exempt from capital gains tax, the population of the village is usually less than 10,000, although specific thresholds may vary by region and state.

### **Details Relevant to Your Case:**

- **Village Name:** Bemakheda, Dist Bidar
- **Distance from Urban Centers:** 4 km
- **Population:** 7,565

Given the details provided:
- **Location:** Since your land is located in a village with a population of 7,565 and it is 4 km away from the urban center, it is likely classified as rural land.
- **Population:** The population of your village is below the threshold of 10,000 for rural classification.

### **Conclusion:**

Based on the information provided, the sale proceeds from the agricultural land in Bemakheda, Dist Bidar, are likely to be exempt from capital gains tax because:

- The land is situated in a village with a population less than 10,000.
- The land is not classified as urban or in the limits of a municipality or municipal corporation.

However, it is essential to verify the specific local definitions and regulations applicable to rural and urban classifications in your region. To ensure accurate tax treatment and compliance with the latest legal provisions, it is advisable to consult with a tax professional or a chartered accountant who can provide guidance based on the most current laws and local definitions.
