income tax return without receipt of form-16

01 September 2009 Sir,
Inspite of many reminders my previous employer has been not issued Form-16 to me against TDS deducted by mistake for the financial year 2008-09
But I have to file my income tax return. Tax on my total income is NIL and
Approximately Rs55000/- I have paid during the year against interest on housing loan.
Please advise can I file ITR-1 without receipt of Form-16 and get refund of TDS deducted by mistake. What is the remedy available to me for:-
1.Refund of TDS deducted and
2. Claim interest on housing loan (Negative income from house property)

01 September 2009 Yes u can do it. Some procedure is there. 1.Registered in tin-nsdl for tax credit

2.print out the credit

3.Filed i.t.r 3

4. Required to mention employer neme and tan no. in the return and that you get from the print out of tax credit.

But ITR-3 is for Individual/HUF being partner in firm.when i was employee in that company.
Is ITR-2 is correct for me?
Please advise.
