Income tax return not filed for ay-2010-11, 2011-12

05 February 2014 Hi,

Yesterday I have received one letter from income tax department as below

Sir/Madam Subject: Non filing of income tax return – Reg\
1. The Income tax department has received information on financial activities relating to you. A list of some of the information for financial year 2010-11 onwards is provided overleaf. As per records, you do no appear to have filled income tax return for Assessment year(s) 2010-11, 2011-12

2. You are requested to furnish your response in the enclosed proforma to the undersigned by post within 10 days. Please not that your personal presence or presence of any authorized representative is not required.

3. if no reply is received, within specified time, it will be inferred that you have not filed income tax return for the relevant assessment years and proceedings under Income tax act, 1961 may be initiated

Actually i was not in India during this time, but i had 6 months of salary in 2010 and i returned in 2013. Am not sure i need to file my tax returns.

What are the consequences??
How should approach now??
The letter dated 20 Dec 2013 but i received yesterday. so the 10 days limit is already over. what would be the action from IT department??
Do i need to get some expert help to resolve this matter??
I live in Canada right now, My parents received this letter and they sent me a scan copy. Is there someone else can respond on-behalf of me??

05 February 2014 Dear Sakthi,

If your income was beyond taxable limits in 2010 then you should have filed your return. For further year your residency needs to be defined.

If it is found that your income was beyond taxable limits and tax has been evaded then tax will have to be paid along with interest and penalty.

I will suggest you to authorize a Chartered Accountant who can represent you and resolve out this issue.

Thanks you so much for your response, I have one more question, i was a salaried personal, and i didnt give any IT declaration to get tax benefits, so while i was paid by my employer they would have completely paid the tax. do i need to still pay the penalty??

05 February 2014 Dear Sakthi,

If the entire tax liability has been paid by you in nature of TDS then you would not be liable to interest and penalty but since you have not filed your Income Tax return so penalty for that will have to be paid by you.
