03 August 2017 If we have claimed more deductions than what we have.. Is it possible to get income tax refund from AY 2017-18 onwards?? Because Dept is issuing notices u/s 143(1)a which asks about clarifications..

03 August 2017 @anil., Your query is not cleared....... So, only can't understand this one for here and also other forums created by you.....

03 August 2017 If you have receipt of deduction then no problem will occur in getting refunds.

03 August 2017 143(1)(a) processing does not go into whether you have claimed excess deduction or not. it checks for general arithmetical accuracy and basic prima facie errors.
so you will get the refund. however, depending on parameters if the case is selected for scrutiny or limited scrutiny then you may have to provide proof for deduction claimed.

Boss, I fail to understand why we should claim deduction more than what we have?


03 August 2017 Mr. Anil, what you say is correct in the sense that this year (Asst. Year-2017-18) , 143(1) notice have been received by many assesses asking them to explain under the "e-proceedings" if the ITR figures does not match with Form-16. There are genuine cases where you would not have declared some investments to your employer before the due date declared by the employer for inclusion. in that cases you would have claimed additional deduction under the respective heads, like 80-C , 80-D, etc. Those cases are picked up by the Department and 143((1) intimations are issued. Even in cases where ITR figures and Form-16 figures matches , the Department is issuing 143(1) asking the Assesses to explain the difference under e-proceeding, where there is no difference and no additional deduction. It really pitiable how an assesse will explain imaginary difference!!!!
