22 June 2017 Hello Respected Experts,

I am doing CA course. My father is a retired army officer and getting pension every month approx 17000 pm. in the month of sept., my received arrears on salary due to which his pension income amounts to approx 4 lakhs. TDS has been deducted. i have read in my income tax module book, income tax is charged only once on 'salary' now i want to know whether whole amount of 4 lakhs charged as income from salary or only amounts of arrears is eligible for filing income tax return

With Thanks
Chetan

22 June 2017 The whole amount will be chargeable to salary if the arrears of salary has not take before for calculating taxable income

22 June 2017 You may also take relief u/s 89 of Income Tax Act

23 June 2017 thanks you sir for prompt reply, but i want to clarify only arrears will not amount to taxable income, why pension received also amounts to taxable income

23 June 2017 Salary is charged to tax only once means that salary is taxable either on receipt basis or on accrual basis. Arrears of salary is taxable on receipt basis in the year of receipt if it is not taxed earlier on accrual basis. Your father can take benefit of section 89(1) relief.
