30 June 2009 In certain condition, an employee can claim both HRA as well as interest on house loan.
Please inform, in which condition an employee can claim both HRA as well as interest on house loan.

30 June 2009 He can claim both but state should be differ with each other.

I take a example for explain this -

A living in Delhi as on rent and A also have a own house at Haryana, then in this case both state (Delhi and Haryana) are differ with each other so A can claim both.

otherwise, employeed person can't be claim both as on same time.

30 June 2009 A am living in Gurgaon (Haryana)as on rent for working purpose and A also have a own house at Ambala (Haryana),where my dependent parents are living. Can I claim both?.
I am paying rent in Gurgaon for working purpose and paying interest on loan related to ambala house, where my parents are living.Daily updown from Ambala to Gurgaon is not possible for me.In this case, why i can't claim both benefit.
Please mention section/circular/notification or any interpretation related to claiming both HRA & Interest on house loan.

01 July 2009 1. You can claim HRA exemption for rent paid for Gurgaon house.

2. You can claim interest on capital borrowed for Ambala house provided income from Ambala house is taxable under head "income from House Property".

3. You can not claim annual value of house as zero (Section 23 (2)) becuse your parents are occupying the house.
