This query is : Resolved

11 July 2016 Dear experts, i have one query. In f.y 2015-16, bankers had deducted tds @20% on fixed deposit due to non furnishing of PAN. n when i came to know all about this, i furnished my PAN no to bankers but they are refusing to revise tds returns of F.Y2015-16 4th qtr..now my question how can i claim refund of my tds amount..

11 July 2016 take form 16A and claim the tds while filing ur return...tax credit will be mismatched and the 143 (1) will be send with demand...go to assessing officer and show him the tds certificate he will give credit to you..

11 July 2016 Sir but in form 16A, no tds amount is reflected as the tds has been deducted against non furnishing of PAN.. As a proof, i have only certificate given by bank showing amount of tds deducted by them...

28 July 2024 To claim a refund for TDS deducted due to non-furnishing of PAN, follow these steps:

### **1. Gather Documentation:**
- **Certificate of TDS Deduction:** This is the certificate provided by the bank showing the TDS amount deducted.
- **Bank Statement:** To show the deduction of TDS from your FD interest.
- **PAN Card:** Proof that you have now furnished your PAN to the bank.
- **Proof of Income:** To substantiate your total income and tax liability for the financial year.

### **2. Verify the TDS Deduction:**
- Check if the TDS amount has been reflected in your Form 26AS (Tax Credit Statement) for the relevant financial year. You can view Form 26AS on the [TRACES website](https://www.tdscpc.gov.in/app/login.xhtml) by logging in with your PAN.

### **3. File a Revised Return (If Applicable):**
- **If You Have Not Filed Your Income Tax Return (ITR) for the Financial Year 2015-16:** File the ITR for that year including the TDS amount reflected in the bank certificate.
- **If You Have Already Filed the ITR:** You can file a **Revised ITR** including the TDS details as per the certificate from the bank. This is done using the **"Revised Return"** option in the ITR filing process. Ensure you select the correct assessment year (2016-17 for FY 2015-16).

### **4. Submit a Refund Claim:**
- **Without Form 16A:** If Form 16A is not available, you can still claim a refund by submitting the TDS certificate from the bank along with your ITR and any other relevant documents.
- **Submit a Rectification Request:** If you have filed your ITR but have not received the refund due to non-reflection of TDS in Form 16A, you can file a **rectification request** on the [Income Tax e-Filing portal](https://www.incometax.gov.in/iec/foportal/). Select the **"Rectification"** option, choose **"Tax Credit Mismatch"** as the reason, and provide details of the TDS deduction.

### **5. Contact the Bank:**
- Though the bank may refuse to revise TDS returns, you can still request a **revised TDS certificate** from them, showing the PAN details if possible. This may help in the rectification process.

### **6. Follow Up:**
- **Keep Records:** Maintain copies of all documents submitted and correspondence with the bank and the Income Tax Department.
- **Check Refund Status:** After filing the revised return or rectification request, regularly check the status of your refund on the [Income Tax e-Filing portal](https://www.incometax.gov.in/iec/foportal/) or through the [Refund Status](https://incometaxindiaefiling.gov.in/eFiling/Services/RefundStatusLink.html) link.

### **Step-by-Step Summary:**

1. **Gather necessary documents** (TDS certificate, PAN card, bank statement).
2. **Check Form 26AS** for TDS credit.
3. **File or revise your ITR** for the relevant financial year.
4. **Submit a refund claim** through rectification if needed.
5. **Contact the bank** for revised TDS certificate, if possible.
6. **Follow up** on your refund status regularly.

If you face difficulties or need further assistance, consider consulting a tax professional who can guide you through the process and help resolve any issues.
