24 November 2009 I have uploaded my Income Tax return for AY 2009-2010 on 26 September 2009.As ITR-V is required to be sent to Bangalore within 60 days, I had sent the same on 23 October 2009. Failing to receive the receipt from Bangalore, I have once again couriered the ITR-V on 10 November 2009. But as on date, I have not received the e-receipt from Bangalore. If the period of 60 days is expired, will my return filed on time be treated as return not filed.

27 July 2024 When it comes to filing your Income Tax Return (ITR) for the Assessment Year (AY) 2009-2010, several key factors are involved:

### **1. **Timely Submission of ITR-V:**
- **ITR-V Form Submission:** The Income Tax Return (ITR) is considered complete only when the ITR-V (Acknowledgment Receipt) is submitted to the Centralized Processing Center (CPC) in Bangalore. This must be done within 60 days from the date of e-filing.

### **2. **Late Submission and Consequences:**
- **Failure to Submit on Time:** If the ITR-V is not received by the CPC within the 60-day window, the return may be considered invalid. The consequence is that the return filed electronically might be treated as not filed, and the tax authorities might consider the return as not filed.
- **Re-filing Option:** If you are within the assessment year or if the assessment year has not been closed, you may have the option to re-file the return. In your case, since the assessment year is 2009-2010, this period has likely lapsed.

### **3. **Documenting Your Efforts:**
- **Proof of Submission:** It’s crucial to retain all records related to your submission efforts, such as courier receipts and tracking details, to prove that you sent the ITR-V within the required time frame.
- **Communication with CPC:** You can contact the CPC in Bangalore to provide evidence of your attempts to send the ITR-V. They may be able to confirm whether your ITR-V was received or advise you on any further steps.

### **4. **Check with Income Tax Authorities:**
- **Contacting the Tax Department:** If you have not received any confirmation and the 60-day period has expired, contact the Income Tax Department for advice. They might provide you with an alternative way to address the issue.
- **Request for Revalidation:** In some cases, the tax authorities may accept an explanation and revalidate the return if you can prove that you attempted to comply within the given timeframe.

### **5. **Penalties and Interest:**
- **Penalties:** If the return is considered not filed, you might face penalties or interest charges. It is advisable to consult a tax professional to understand any potential liabilities and remedies.

### **6. **Future Actions:**
- **Ensure Timely Submission:** For future returns, ensure that the ITR-V is sent well within the deadline to avoid such issues. Consider sending it via a method that provides tracking and acknowledgment.

### **Summary Steps:**

1. **Gather Proof:** Collect all documents and proofs of sending the ITR-V, including courier receipts and tracking details.
2. **Contact CPC:** Reach out to the Centralized Processing Center in Bangalore to inquire about the status of your ITR-V.
3. **Consult a Tax Professional:** Seek advice from a tax professional to understand the implications and possible next steps.
4. **Re-file if Necessary:** If advised, re-file your return or address any penalties or issues as directed by the tax authorities.

**Note:** Given that this is related to a previous assessment year, consult a tax advisor for specific guidance on addressing historical filing issues and any potential remedies or penalties.
