As per the current GST late fee structure for filing GSTR-3B:
1. **Late Fee Calculation:** - Late fee is Rs. 50 per day (Rs. 25 per day for CGST and Rs. 25 per day for SGST) of delay in filing, subject to a maximum of Rs. 5,000. - If you file your GSTR-3B on 5th September 2020 for the months of May 2020, June 2020, and July 2020, the number of days of delay would be as follows: - May 2020: Approximately 98 days (from 20th August to 5th September) - June 2020: Approximately 75 days (from 8th August to 5th September) - July 2020: Approximately 47 days (from 29th August to 5th September)
2. **Total Late Fee Calculation:** - May 2020: Rs. 50/day * 98 days = Rs. 4,900 - June 2020: Rs. 50/day * 75 days = Rs. 3,750 - July 2020: Rs. 50/day * 47 days = Rs. 2,350
Total late fee = Rs. 4,900 + Rs. 3,750 + Rs. 2,350 = Rs. 11,000
3. **Maximum Late Fee Cap:** - Since the late fee is capped at Rs. 5,000 per return (Rs. 2,500 each for CGST and SGST), the total late fee for each month will be Rs. 5,000 if filed after the due date.
Therefore, if you file your GSTR-3B for May 2020, June 2020, and July 2020 on 5th September 2020, the total late fee applicable would be capped at Rs. 15,000 (Rs. 5,000 for each month). It's advisable to file and pay the late fee promptly to avoid further accumulation of penalties and interest.
