Gstr-1 return periodicity

17 December 2017 Dear Sir,

In the 23rd council meet of GST it was announced that there will be now 2 types of returns i.e. Monthly and quarterly basis for turnover of more than 1.5 crore and less than 1.5 crore respectively.

My question is if a person with the same PAN is has having 7 different registrations in different states, how will the return periodicity decided in such case because as one PAN the person's turnover is more than 1.5 crore but with different GST registrations in different status the turnover is less than 1.5 crore in each state.

Please reply if anyone has the answer to my query.

18 December 2017 No... The Turn Over based in PAN not on GSTIN. So, You ll be file your GSTR returns based on Above 1.5cr option as Monthly Return...

18 December 2017 Just it's based on turn over. Also no more notification for above. Govt can't give notifications for every single point of view. We ll just understand the law and rule and take decisions...

18 December 2017 Notification 57/2017 (Central Tax ) dated 15.11.2017 prescribes quarterly return for taxpayers with reference to aggregate turnover is upto 1.5 crores. As per Section 2(6) of the CGST Act aggregate turnover is computed per assessee on PAN India basis.

22 December 2017 We are running a hall in Karnataka. One registered party from Maharastra wants to conduct a program in the hall. They have provided their GSTIN to us. We have charged them IGST. We want to know whether it is correct or not? Place of supply is Karnataka and invoice is being raised from Karnataka.

26 December 2017 Since both location of supplier and place of supply is Karnataka, CGST/SGST shall apply; Pl. refer 12(3) of IGST Act;
