Dealer itc credit claim (medicines purchases ) on in patients sales turnover or out patient turnover or total hospital collection turnover gst out put itc applicable in gst act.

07 July 2024 In the context of a private hospital that includes a medical store selling medicines, the treatment of Input Tax Credit (ITC) under GST depends on how the medicines are used and accounted for within the hospital's operations. Here’s a detailed explanation:

1. **Nature of Supply of Medicines**:
- **In-patient Sales**: Medicines sold to patients admitted to the hospital (in-patients) are typically considered as part of the healthcare service provided by the hospital. The GST charged on these sales can be part of the hospital’s output tax liability.
- **Out-patient Sales**: Medicines sold to patients who visit the hospital for consultations or treatments (out-patients) are also considered as taxable supplies. GST is applicable on these sales as well.

2. **Input Tax Credit (ITC) on Medicines**:
- **In-patient Medicines**: If medicines are provided to in-patients as part of the hospital's healthcare services, the hospital can claim ITC on the GST paid for purchasing these medicines, provided they are used for providing healthcare services and not for personal consumption.
- **Out-patient Medicines**: Similarly, ITC can be claimed on medicines sold to out-patients, as long as the GST paid on these medicines is properly documented and accounted for.

3. **Calculation of GST Output Liability**:
- The GST output liability of the hospital will include the GST collected on the sales of medicines (both in-patient and out-patient) and other services provided.
- The hospital can offset this liability against the eligible ITC available on inputs (including medicines), input services, and capital goods used in the course of providing healthcare services.

4. **ITC Utilization**: The hospital can utilize the ITC against its output tax liability in the following manner:
- ITC can be used to pay GST on taxable supplies made by the hospital, including sales of medicines.
- The hospital needs to maintain proper records to demonstrate that the ITC claimed is directly attributable to taxable supplies.

5. **Compliance and Documentation**:
- It's essential for the hospital to maintain accurate records of purchases, sales, and GST payments to support the claim of ITC.
- In case of any discrepancies or audits, the hospital should be able to provide evidence that the ITC claimed is legitimate and relates to taxable supplies.

In summary, a private hospital including a medical store can claim Input Tax Credit on GST paid for medicines purchased, provided these medicines are used in the course or furtherance of taxable supplies such as in-patient and out-patient treatments. The GST output liability would include the GST collected on sales of medicines, which is offset by the eligible ITC available to the hospital. Proper documentation and compliance with GST regulations are crucial to ensure correct ITC claim and utilization.
