GST on dating services

This query is : Resolved

02 May 2023 I run an online dating service. The customers are worldwide including India. How is GST applied? Do I have to charge GST to customers? Do I have to pay GST and at what rate?

07 July 2024 As an operator of an online dating service catering to customers worldwide, including those in India, here’s how GST (Goods and Services Tax) would typically apply:

1. **Nature of Service:**
- Your online dating service is classified as an electronic service provided remotely over the internet.

2. **Place of Supply:**
- For B2C (Business to Consumer) transactions, the place of supply rules under GST in India generally follow the destination principle. This means:
- If your customer is located in India (Indian resident), the place of supply is in India.
- If your customer is outside India (non-resident or foreign resident), the place of supply is outside India.

3. **GST Applicability:**
- **Services to Indian Residents (B2C):**
- If your customer is located in India (Indian resident), and you are providing the service from outside India, technically, GST may apply under the Reverse Charge Mechanism (RCM). This means the liability to pay GST rests with the recipient of the service (your Indian customer).
- However, as of now, there’s an exemption for B2C supplies of online information and database access or retrieval services provided from a place outside India to non-taxable persons in India. This exemption means you may not need to charge GST to your Indian customers directly.
- It's crucial to monitor updates and consult with a GST expert to ensure compliance with current regulations.

- **Services to Non-Residents (B2B or B2C):**
- If your customers are located outside India, and you are providing the service from outside India, generally, GST is not applicable.

**GST Registration:**
- Depending on the turnover and other criteria, you may need to consider GST registration in India if your services fall under taxable supplies and you exceed the threshold limits set by GST regulations.

**Tax Rate:**
- If GST applies to your services provided to Indian residents under the RCM, the applicable rate would depend on the category of services your dating platform falls under. Currently, services like online information and database access have specific rates or exemptions, which you should verify with a GST consultant.

**Compliance:**
- Ensure that if you are required to charge GST, you issue proper tax invoices, maintain records, and file GST returns as per the regulations.

Given the global nature of your service and the complexities of international tax laws, including GST in India, it's advisable to seek advice from a qualified GST consultant or tax advisor who can provide guidance specific to your business model and transactions. They can help ensure compliance with GST regulations and optimize your tax obligations accordingly.
