19 March 2010 See, If supplier is not separately charging for Freight it means that it is inclusive amount. Liability of Service Tax & TDS Deduction is also on Supplier as he is the person receiving the services. As he has not charged any amount to you for freight it means you have only paid for Goods & not for Freight.

To be on safer side, You can either ask for copy of challan through which supplier has paid service tax on Freight or You can ask for a declaration by the supplier stating that the Service tax will be borne & paid by him & there is no liability on you for the same.
