ASK your Client(Government office) to write a letter to ADDITIONAL COMMISSIONER (TDS) of your Region stating that "we were not allotted BIN by DTO/PAO, and hence we are unable to file the quarterly return and individual return of income within the stipulated time" In turn within 30 days the ADDITIONAL COMMISSIONER OF INCOME TAX (TDS) will issue notice and direct the DTO/PAO to file FORM 24G if the DTO fails penal proceeding will be initiated against DTO's.
Where as what I have done in our district was as follows. 1) First I have approached the Local Sub Treasury officers,- but they are totally unaware of FORM 24G. 2) I have approached the DISTRICT TREASURY OFFICER and requested them to file FORM 24G. As they are CA's,ICWA's AND AIMC professionals they have understand the concept of filing of FORM 24G 3) Whereas one TIN-FC has misguided the entire OFFICES and they have represented with the particulars of FORM 24Q, a FORM 24G will be completed. That makes a hault on filing of FORM 24G by A.O.
4) I have approaced the REGIONAL DIRECTOR OF TREASURIES AND ACCOUNTS through RTI and required some particulars. 5) simultaneously I have given a complaint to TIN-NSDL about the Mis-use of Power by TIN-FC. NSDL warned the TIN-FC. 6) on 30/08/2012 in our region all the A.O's who have got AIN filed FORM 24G for the year ended 31.03.2012 and for the period ending on 30.06.2.2012. 7) Please note that the entire process has taken 5 months. NOW our office is matching all the BIN of Government Clients and filing process is going on.
