Sir, if any one didn't have PAN and give Form 15G/15H and along with that he give Form 60/61 in place of PAN card copy then can he take the benefit of non deduction of TDS? or the bank will be liable for deduction of tax in such case?

Thanks Sagar doshi ji for your concern.
I made reply on the basis what India Law , i.e. income tax act contains about your query, the law is still the same which I stated, the court just made a verdict, the decision can not change the law.
Moreover, you have wrongly interpreted the case, The Actual Case is on ""No TDS at 20% under Sec 206AA if PAN is not furnished and income is below taxable limit – Karnataka HC""
And your query is on "" whether PAN is mandatory to avail the benefit of 15G/H""
Hence, both the things are different. Hope i clear your view now.
