We have an Insurance Policy for special perils which covers Damage directly by flood, recently due to flood (just because of the flood) a few logs/boulders (floating in the flood water) damaged our assets, the Insurance company rejected our claim. Is the Insurance Company correct in doing so? Is there any way in which the claim may be obtained?

You have not got the point.. I dont want to complain... I first want to know whether the claim of the Insurance Company is correct or not....

In your situation, the denial of the insurance claim by the company raises questions about the coverage under your special perils insurance policy. Typically, insurance policies vary in terms of what constitutes coverage for flood-related damages. Here are some considerations:
### 1. Policy Coverage: - **Special Perils Coverage**: This type of coverage generally includes a wide range of risks, often referred to as "all risks" or "open perils" coverage. It typically covers damages caused directly by flood waters, such as damage to structures and contents from water entering the insured premises.
- **Exclusions**: Insurance policies often have specific exclusions. For example, coverage might exclude damages caused by objects carried in flood waters, such as logs or boulders, unless these items were part of the insured property or structure.
### 2. Review Policy Terms: - **Examine Policy Language**: Review your insurance policy documents carefully, especially the sections on covered perils and exclusions. Look for any specific language regarding coverage for damages caused by items carried by flood waters.
- **Contact Your Insurance Agent/Broker**: Discuss the denial with your insurance agent or broker who helped you purchase the policy. They can provide insights into the specific reasons for the denial and clarify the policy terms.
### 3. Appeal Process: - **Appeal the Decision**: Most insurance companies have an appeals process. If you believe your claim should be covered based on your policy terms, gather documentation supporting your claim and formally appeal the denial with the insurance company.
- **Legal Advice**: If the appeal is unsuccessful and you still believe the denial is unfair or incorrect based on your policy terms, consider consulting with a lawyer specializing in insurance law. They can review your policy and provide legal advice on potential next steps, such as mediation or litigation.
### 4. Documentation: - **Document the Damage**: Ensure you have documentation of the damages caused by the logs or boulders, including photographs, repair estimates, and any correspondence with the insurance company.
### Conclusion: Whether or not the insurance company's denial of your claim is correct depends on the specific terms of your policy and the circumstances surrounding the damage. It's important to carefully review your policy documents, seek clarification from your insurance agent, and consider appealing the decision if you believe the denial is unjustified. If needed, legal assistance can provide further guidance on your options.
