Hi Friends!

I am a Chartered Accountant (May 2006) and a Post Graduate (2005) from Calcutta Universuty. I hold in total 16 years of work experience in the field of accounting, taxation, audit, MIS, budget, commercial, planning and control. During my journey of experience and knowledge I got the previlege of working with big conglomerates getting experiences in manfacturing, construction, telecom, BPO and ITes.

    Dear Sir I am a employe in UTRAKHAND & here there is a income tax exemption for 10 Year. My Problem is :- 1- Will i deduct TDS on bills which i received from transporter ( any taxable (tds) bills) A- Transporter from Uttrakhand (Income tax exempt) B- Transporter from Out side Uttrakhand (Not exemption) 2- Will i Pay TDS on our Service bill if No which certificate have to issued please advise jiwanpokhariya@gmail.com

    You are absolutely correct. Service Tax should be calculated on the value of actual service provided. In the instant case, service recipient has availed cenvat credit of full amount i.e. of Rs. 24,000/- and released the payment including Rs. 24,000/-. Hence service tax to be paid by the service provider has to be not less than Rs. 24,000/-. Other option is service provider can ask the service recipient to return the bill and raise revised invoice and charge service tax on this revised amount and pay accordingly. If the recipient is ready to reimburse Rs. 24,000/- as service tax, why to complicate the matter. Please let me know your views.

    But sir i read a circular no.715 before some Plz clear my proble again Payments to recruitment agencies - Payments to recruitment agencies are in the nature of payments for services rendered and not for carrying out any work including supply of labour for carrying out any work. Hence provisions of section 194C will not apply. The payments will however be sub­jected to TDS under section 194J. Similar would be the position in respect of payments made by a company to a share registrar—Circular : No. 715, dated 8-8-1995.
