Exemption from TDS

29 April 2010 Hello,

I have one of my clients who is a hospital and they have formed a private limited company.

They want to apply for exemption from TDS on the contention that there are huge losses in the organisation and till the time profits will not be there no one should deduct TDS from payments made to them since they have to claim refund of the TDS everytime since last three years.

Kindly advise whether this can be done.

well there is no problem to claim IT refund everytime... atleast they are getting thats important..
Moreover for your query, you need to write an application to CIT of the ward regarding same and have to submit to his office. they will issue a certificate stating the same not to deduct tds.. You have to convince them about the hospital and profitability.

You can make application in prescribed form to your jurisdictional officer alongwith last years financials and can convince them why not TDS be deduted on payment to be made to hospital.
