My sole proprietorship concern exported the adhesive on credit to the overseas buyer and received the duty drawback from the Government of India. This amount was directly credited to the account of the concern. After the export is made , the goods are found to be defective . The overseas buyer has not paid for the goods as the goods were defective. My query is whether the duty drawback received has to be paid back to Govt. Of India ? If yes , what is the procedure i.e. to which authority amount is to be paid , whether interest should be included ,in whose favor cheque / draft should be drawn, whether any form is to be filled in etc.

Now you are advised to submit drawback alongwith interest 18% P.a. the date which have you received it, otherwise DRI and more department will issue SHOW CAUSE NOTICE TO YOU.
