one of my client is a salaried assessee and has filed ITR-1 for the AY 2011-12 in bangalore on the company's address (bangalore) on 06th july 2011.
Last year he has shifted to mumbai. He has received notice u/s. 143(2) of the income tax act 1961 at employers address in bangalore requiring him to appear before them either in person or through representative on 05/09/2012 . date of notice is 28/08/2012.
i have seen the notice and i do not think it is in order due to following reasons. 1. time gap between date of issue of notice (28/08/2012) and date of appearing (05/09/2012) only 9 days. 2. No phone no. is mentioned in the notice. 3. email id is :BANGALORE-CCIT-3_ITO-W14-10 @ income.gov.in 4. my client has been writing email on above id that it is not possible for him to appear in bangalore either in person or through representative, but their is no reply from their side. i request experts and friends to answer my following questions; 1. is notice in order ? 2. if anser to 1 is yes, then what should in this case, it is not possible for me to go to bangalore ?
You can send a letter by registered post requesting them to give new date for appearing before them giving reason for non appearance. Thanks Mahendra FCA Bangalore
