Deduction of tds inclusive of service tax

05 May 2012 Sir,

We are paying Rent of Rs. 9000O/per month from the service income received. Should we deduct and pay TDS for it with inclusive Service tax or Excluding Service tax.

05 May 2012 no need pay TDS on payment of rent Rs. 90,000 as the exemption is Rs. 1,80,000. That to service tax is not part of Amount for the amount for deduction of TDS U/S 194I. if the is amount is more than Rs. 1,80,000 p.a, then TDS should be deducted on the amount exclusive of TDS.

TDS IS TO BE DEDUCTED EXCLUDING AMOUNT OF SERVICE TAX..AS PER CBDT CIRCULAR NO. 4/2008.DATED 28.04.2008
