02 December 2013 Our company got customised Mediclaim Policy for our employees and their family. The premium is paid by the employees to our company and the same is reimbursed to the Insurance Company for providing Medicalim facility. Certain employees opted for the EMI facility for the payment of Mediclaim premium from our company since the same is not available from the insurance company.

Now, example- Mr. X's total premium payable is Rs. 18000 (Rs. 5000 of his and rest Rs.12000 premium is of his dependent senior citizen parents) which is payable by him in 6 instalments of Rs. 3000 each starting from 1st Dec 2013. So, during f.y.2013-14 the total premium paid by him in EMI to company would be Rs.12000 and rest Rs. 6000 would be paid by him during f.y. 2014-15. But the company on his behalf had paid the entire premium to the Insurance company in Nov 13.

So, will Mr. X be eligible to claim deduction under Sec 80D of Rs. 18000 or Rs. 12000?

02 December 2013 Rs.18000. Pending recovery from employees will be shown as advance to staff or staff advance as the case may be depending from company to company.
