Bank have deducted tds on Interest on FDR of Rs.78917/- and file his eTDs return without mention of our PAN. Now have recived the demand notice from Income Tax department of the same amount.
We told to bank for filing of revise return but no proper reply received. Thery are not ready to file revise return.
We have the original Tds certificate. Pls advise us how to get the credit from Income Tax department If party not ready to file thier revise return nor make the tds payment to us.

you have recd original copy of TDs certificate write a letter to your Income tax Officer attaching copy of such TDs certificate. only income tax officer is authorised to correct it.

In my view TDS will be credited to a person account if there is PAN available with deductor. If no PAN provided or not quoted by the Deductor in the TDS return filed by the deductor then in whose account TDS will be credited?
I think you got TDS certificate containing the Provisional Acknowledgement Number for the TDS return filed. This will help you to show the banker, who has deducted TDS, that they have not mentioned Your PAN No and ask them to issue a certificate containing your PAN number (Probably they will issue a duplicate certificate)
