My wife had won a price money in the year 2010 of Rs.1,11,000/- (Appx) from a TV game show. Out of which they have deducted TDS of 30%, which amounting to Rs.30,000/- appx.
Yes, definitely you can claim that TDS FROM IT DEPT. Please try to follow , what i am saying now, 1)First you check 26AS FOR THAT PARTICULAR ASSESSEE FOR THAT A.YEAR & VERIFY THE AMOUNT OF TDS WITH THE TDS CERTIFICATE GIVEN BY TV SHOW AUTHORITY. 2) IF 26AS SHOWS OF RS. 30000/= TDS FOR THAT PARTICULAR ASSESSEE, THEN IMMEDIATE , WITHOUT WASTING ANY TIME ( BECAUSE YOUR DEADLINE IS 31/03/2013 FOR A.Y 2011-2012 ), FILE THE IT RETURN THROUGH E-FILING , SIGNED THE ITR-V WITH BLUE DOT BALL PEN ONLY & SEND TO CPC BANGALORE WITH SPEED POST & DON'T MENTION --> " POST BAG NO 1 " in case of Speed POST. 3) WAITING FOR 143(1) i.e, intimation order. & one thing you must remember, THAT --> put the EXACT AMOUNT OF TDS ( AS WELL AS lottery INCOME ALSO ) INTO THE RETURN FORM ( in your case, FORM ITR-2 applicable as you have only lottery income ) AS REFLECT IN 26AS because if there is any mismatch , then you may be in a big trouble. Unless & Until 26AS Shows full amount of TDS, You can't claim refund from IT DEPT., So, it's a very bad news that in 26AS TDS Shows as " no transaction present " for that particular assessee . I therefore request you, for an appeal to the " Commissioner of TDS " of that particular Circle mentioned in your TDS Certificate against the deductor ( i.e, TV Show authority )for non submission of TDS Return.
