Dear Experts we provide courier services . we also own 6 vechiles.In our GST registration certificate we have mentioned services as others. For transportation of courier we use are vechiles. Do we fall under the category of GTA & can we charge 5 % GST when we raise the invoices without taking ITC .
or else we need to take a GTA registration under GST.

GTA is a transport agency which is engaged in transportation of goods and issues a consignment note by whatever name called. You are using your vehicles for courier services and not goods so you are not liable to charge separate GST for GTA.

Yes you can take GST registration as GTA and charge GST at 5% with no ITC. but if as GTA your all supplies are made to persons specified for RCM under section 9(3) then no need to take registration as per GST rules and circulars. In that case you need not charge GST. In any case on GST services RCM applies so no need to charge and deposit GST.

Courier and GTA both are different so define nature of your business carefully keeping in view purpose and not just from tax compliance point of view...
