HI please tell me My company is service provider ( m.s.o) and receiving serivice from pay channels( broad casting) , but company is not paying bill fully, e g bill of rs 100+12.36=112.36 company pays 90+ service tax which comes to lesser amount of 112.36, how can we take credit of cenvate on amount paid on 90+ service tax ,

You can take the credit of the amount of service tax paid, even though the bill carries higher amount, you stand eligible for the amount paid by you.
In case if you intend to pay the balance amount at a future date you can avail the proportionate credit as well.

in our case , superintendent of Excise said that bill partly paid or paid on account is not elligible for Cenvate Credit, as per Cenvate Credit Rules

as per cenvate rules, 4 (7)says the cenvat credit in respectio of input service shall be allowed on or after the day which payment is made of the value of input service and the service tax paid r payable as is indicated in invoice , bill or as the case may be . in view of the above how can claim for on account payment made for a bill , please reply
