Dear experts ours co., is mining business,in our a/cs section auditors fees bill taken as cenvat credit but they are not taking cenvat credit of legal and professional fees bill what is the reason for it any rules regarding cenvat credit for legal and professional fees

Before 01-05-2011 any type of legal service was not taxable in the bill the advocate would not have added service tax
Where as a chartered Accountant is liable for service tax hence he would have added service tax in his bill that is why they would have taken cenvat credit
Service tax for a chartered accountant is applicable with effect from 16/10/1998
Now Advocates are also liable for service tax for certain type of legal services with effect from 01/05/2011 Exemption of service Tax Rs 10 lacs in aggregate

With effect from 01/05/2011 1.To any person by business entity in relation to advice, consultancy or assistance in any branch of law in any manner 2.to any business entity, by any person, in relation to representational services before any court, tribunal or authority, 3.to any business entity, by an arbitral tribunal, in respect of arbitration.
