cable operator service

21 December 2007 we are servise provided to our customer as
a cable operator.We are paying subscrption to various channles from 2004.they are charged service tax seperately whether we are taken cenvat credit(service tax credit)on our input srvice pl.reply

21 December 2007 Hi Hemant,

Service tax payable by an assessee shall be subject to the assessee's availing of CENVAT credit as per CENVAT credit rules, 2004, w.e.f. 10-09-2004.

Output service provider shall be allowed to take credit of tax paid on the inputs and input services only after he makes the payment for the value of input service or the service tax payable there on as indicated in the invoice of the input service provider.

For availing credit, proper documents and accounts as per Rule should be maintained (including invoice/challan/bill of entry etc) Rule 4A of the service tax rule also provides that taxable service should be provided or credit should be distributed only on invoice, bill or challan.
