CA As Partner & Individual

This query is : Resolved

02 January 2010 I want to know in what capacities a practising CA can work.

Whether a practising CA can join partnership in an existing firm and can run his individual practise as well. If so what will be the status in both the cases.

What can be other permutations & Combinations. Please advise

02 January 2010 You can practice in your own name along with the partnership. However the deed must allow the same. Also the limit requirement of the companies act and income tax act on maximum no must be adhered to.

02 January 2010 1. As a Proprietorship. (Full time)

2. As a partner in partnership. (Full time)

3. As a prop in your own firm and partner in the partnership. You will part-time in both firm.

02 January 2010 i think you can practice in firm name only, not your own name.

04 January 2010 No, You don't need a firm name to practice as a individual. Individual can practice at their own name.

04 January 2010 if you regestire or not as individual then you can practice your own name , but in case of you become partner in partnership firm you should practice in firm name only.

04 January 2010 Mr. Tilak please understand my point. please correct me if i am wrong.

05 January 2010 Yes for a partnership firm a firm name and even a partnership deed is compulsory. So when you join an existing partnership firm then that firm have a firm name already. To create a new partnership firm, you need to draft a deed with your other partners and also should have a firm name.

To practice as an individual firm name is optional.
