Currently we are looking for an import of a snack food from Philippines. I have referred to the Tariff notification for BCD as given by India for ASEAN Countries & specific tariff commitment given for Philippines.
In this case, my query is what shall be the rate of BCD to be taken. Is it like we have to take the tariff rate that is most beneficial to us?
As the notification for ASEAN countries also includes Philippines in that. It then means that such tariff commitment rate given supersede the tariff rate given for Philippines specific.
Please respond on the same.

We are planning to buy a software from ebay.in (GLOBAL EASYBUY). The seller is in abroad and ebay.in has listed the item in INR. The item price includes custom clearance fee and shipping fee etc. The seller says they will give me an invoice at the time of delivery and it will not contain any receipt for custom fee paid. Since this product is coming from abroad
1. KINDLY LET ME KNOW IF I HAVE TO HAVE A COPY OF CUSTOM FEE RECEIPT?
2. WHAT OTHER RECEIPTS I SHOULD HAVE TO USE THE PRODUCT LEGALLY IN INDIA?

Movement of goods from one customs warehouse to another customs warehouse, filed Shipping Bill for export of Duty free goods ex-bond and mentioned amount duty amount (Total Duty Foregone) and sale of value of goods.
But, how this (TDF) is relevant for clearance of goods at the time of Ex-bond B.E.
In the place of TDF words what other words can be used ?

The importer at the time of clearance from Customs Warehouse, has submitted CDEC ( Customs Duty Exemption Certificate) under Cus Nofn. 39/96 for Defence supplies.
AS far as value is concerned, for ex-bond, the value of goods are higher than into bond goods and at the same time duty also proportionately increased.
Our Query is the total duty amount which was shown in the S.B., shall be compared to Ex-bond B.E when the importer clear the goods under Cus Notfn. 39/96 ( fully exempted all duties) & submitted the CDEC .
Is it correct or not ?
It is my opinion that when the goods are got exempted by virtue of Customs notification no. 39/96, the duty amount which was shown in the S.B is not at all comparable with the clearing value of goods and duty.
The above query is raised by the Superintendent of Customs & Central Excise, Hyderabad.
Pl. justify as early as possible.

1. duty paid in connection with import of product .
whether it is added to cost of purchase or traded as expense.
2.If imported product are export
In this case whether we have get any exemption on customs duty which we are already paid .If any such exemption is available kindly advise formalities for claim that benefit

We have two seperate Manufacturing Units, havinge seperate Excise Jurisdiction & ECC Nos, but under One Company Name & Common IEC Code.
I intend to sale Imported material on High Seas Basis from One Unit to another.
The question is , is it permitted under Customs Law ?
