One of my friend whois a CA (final) student has discontinued to go to the articleship due to some dispute with the principal since last 15 months. Now the period of articleship for which the contract was executed has been completed. whay are the steps that she should take to take to get a complition certi from the principal if he has denied to do so...????? even he is not ready to sign 108 with excess leave. Please tel what to di????

Its his (ur frnd) fault.. I mean, whatever the dispute was, he wud have settled it down.., either by taking transfer/secondment or some mutual agreement... Now if his boss denies, legally he cant do.., rather ICAI can enforce him to attain the articleship for such absent period.... But still, i think some professional person or rather some experienced CA shud comment on this....

As per the regulations, after completion of articleship period if the principle denies to sign form 108, the article can send request to ICAI giving all the respective details. ICAI will then send an officially marked form 108 to the principle who has to sign it within the given period which is generally 15 days.
The principal at the most can consider all the 15 months towards leave taken and even some more. No worries, register under some other principal and serve the same period as excess leave.

Dear Monika, as I earlier said for the soft copy you need to give me your email id.
As far as exams are concerned, your friend cannot appear for the same until she completes the total excess leave period as stated by the principle in her form 108.
