if an individual have Rs.400000 non agriculture income and agriculture income of Rs.700000, then whether surcharge will be applicable or not?

04 September 2007 hi,
As per income tax act 1956, surcharge is applicable to an individual if his income exceeds rs. 10,00,000.
As per your query the individual has Rs. 4,00,000 as non agriculture income and Rs. 7,00,000 as agriculture income. This aggregates to 11,00,000. but the amount of rs. 7,00,000 is exempt u/s 10(1) and shall not be included in the total income of the individual. Thus total income of an individual will be Rs.4,00,000 and tax shall be calculated by partial integration.
Thus the conclusion for your query can be that surcharge will not be applicable on above.
