Adapted child school fee under section 80c

I need a detailed clarification on claiming school fee of adapted child.

Section 80C says we can claim tuition fee of adopted child. Below are my doubts.

1. Do we need to submit any proofs for claiming adopted child school fee.

2. If no other documents are required other than fee receipt, then every body can submit bill and claim the exemption.

3. It seems to be a loophole in law. Please explain in detail if not.

05 February 2015 section 80C no where mentioned for adopted child. But for adopted child can also claim deduction. No need to submit any proof . But its better to be ready with legal papers if any.

Then we can easily get school bill receipts. Instead of taking housing loan for tax exemption, why don't we make use of this section for decreasing tax burden. I can say that I paid school fee of my servant, my relative like that.

What do you say.


06 February 2015 There is another loophole in this provision, 80C provides for deduction for two child of the assessee. But it is nowhere mention that two child of husband and wife together can only be claimed. In absence of clearity if couple have four child's then both can claim deduction of tuition fees paid for two child each.
As far as your case is concern, yes you can claim deduction as act lacks clarity in this regards. But if AO demands for proof then you must provide legal document for adoption of child.
