Dear Sirs,

In our company we are paying to our employees (not to the landlord) for accomodation.

Please advice on the subject matter whether we can consider this amount as part of PERKS and can give deductions under new PERKS Rule ? Please note that we are paid fix amount to employee as per appointment terms and part of CTC directly to employee.

16 February 2010 This will be considered as House Rent allownace since it is being given to an employee' not landlord. It can;t be regarded as PERKS.

The employee can claim the exemption of HRA as per section 10(13A) read with Rule 2A subject to fulfilment of certain conditions.
