About signed ITR

07 September 2008 Is there any penalty, if you submit a ITR (return) without signing it?
If yes, then of how much amount.
If no, then what will it be?

07 September 2008 There will be no " Filing of return " in this case. Consequences of not filing a return will follow.

08 September 2008 Under Section 140 "Signing of Return", if an assessee files his return without signing the same, it will be "void ab initio". That is, it will be considered as if the assessee has not filed his return.

09 September 2008 un signed ITR is invalid return

09 September 2008 But in Section 140A (Penalty) of Income Tax Act, 1961 it is stated that you will be charged Rs. 10000/- for submitting a return without signing it. Is it or ITR will be void ab initio.

11 September 2008 I have never read any such section which deals with the penalty on non signing of return. I think what Lovely has mentioned is the penalty for un-signed documents at the time of income tax proceedings. Please clearly mention the provisions.
