No, you can not. If deductor is not furnishing the form 16 then as per S.272A(2)(g) , he shall be liable for penalty of Rs. 100 per day for each day of default. You may lodge a complain, in written, to your AO against the deductor and then he will forward the case to the AO of the deductor (if he is not the AO of deductor aswell as yours)
