Tds on rent. less than 1,80,000 pa

If a company is paying rent less than 1,80,000 pa. and company is deducting tds @10% rate. It is possible that owner of immovable property can raise any objection and what can be possible results of this ??

28 May 2014 yes surely he can raise objections but as far as i concerned, legal implications are not there for deducting excess TDS.

at last he can say to vaccate his place...

28 May 2014 Hi Divya Agarwal,
First the owner has to intimate the company not to deduct TDS on rent which is less than Rs 1,80,000 pa & make it as a record either thro e-mail / letter.
Even after intimating & if TDS is deducted then the owner has the right to object / sue on the company based on his records.

Dear sir please quote the provisions also where one can sue the company for deducting excess tds..

I had seen mostly companies deduct tds to be on safer side because excess deduction will not be a problem for them but if they deduct less tds then it should be , it will create huge problems
