The Ministry of Finance has issued Notification No. 17/2024-Central Tax on September 27, 2024, outlining the commencement dates for several provisions of the Finance (No. 2) Act, 2024. Key provisions related to the Central Goods and Services Tax (CGST) Act, Integrated GST (IGST) Act, and other taxation laws will come into effect on specified dates.
Effective Dates and Provisions
Immediate Effect from September 27, 2024
- Section 118: Amends Section 16 of the CGST Act, introducing sub-sections (5) and (6) related to conditions for availing input tax credit.
- Section 142: Relates to the Constitution of Appellate Tribunals under Section 109 of the CGST Act.
- Section 148: Pertains to Section 171, addressing anti-profiteering measures.
- Section 150: No refunds for taxes paid or input tax credit reversed under Section 118 with retrospective effect from July 1, 2017.
Coming into Force on November 1, 2024
Several other provisions will be operational from November 1, 2024. These include key amendments to CGST, IGST, and UTGST Acts, such as:
- Section 114-117: Addressing tax levies, the composition scheme and time of supply.
- Sections 119-157: Cover topics like tax invoices, refunds, scrutiny of returns, penalties, transitional arrangements for input tax credit and amendments to IGST and UTGST Acts.
These amendments reflect significant changes in India’s GST framework, particularly in tax compliance, refund mechanisms, and penal provisions.
