In a startling development, the Directorate General of Goods and Services Tax Intelligence (DGGI) Mumbai Zone has reportedly issued a hefty notice amounting to a staggering Rs 28,000 crore to the prominent online gaming company, Dream11. Alongside this, DGGI Mumbai has also set its sights on Play Games 24X7, demanding a substantial sum of Rs 21,000 crore. These actions have unfolded against the backdrop of a tumultuous tax dispute between the state and central tax authorities and Dream11, one of India's foremost online fantasy sports gaming platforms.
Dream11's tax woes began with a notice from the Maharashtra State GST Audit authorities, who initially sought Rs 18,000 crore from the company. The genesis of this dispute traces back to the alleged misclassification of Dream11's online fantasy sports gaming activities, prompting the Maharashtra state authorities to embark on an audit in December 2020. The audit culminated in the issuance of final audit reports on January 10, 2022, and January 6, 2023, compelling Dream11 to take legal recourse by filing a writ petition before the Bombay High Court.
The latest chapter in this ongoing saga reveals that Dream11 has found itself at the center of a tax storm, with the DGGI Mumbai Zone accusing the company of non-compliance and failure to submit the requisite documents despite multiple reminders. In response to mounting pressure, the DGGI conducted an exhaustive inspection on September 14, 2023, aiming to shed light on the complex tax issues at hand.
Dream11's efforts to address these concerns materialized in the form of GST DRC 01 documents, covering the financial years 2017-18 and 2018-19, which were submitted by the state government of Maharashtra on September 12, 2023.
