ORDER

This appeal by the assessee arises out of the order dated 05-12-2016 passed by the CIT(A)-2, Pune in relation to the assessment year 2012-13.

2. Before us, the assessee has filed a letter dated 31-03-2021 seeking withdrawal of the appeal. The relevant contents of such letter reads as under:

“1. The assessee’s above appeal was dismissed ex-parte by the Hon’ble SMC Bench, ITAT, Pune, vide order dated 28-08-2018. The assessee filed MA under section 254(2) against the said order. The assessee’s MA was admitted and the Order dated 28-08-2018 was recalled. Thus, the assessee’s Appeal No.751/PUN/2017 was revived. The assessee filed an application in Form No.1 and 2 under the Vivad Se Vishwas Scheme, 2020. The Hon’ble PCIT-2, Pune has issued Form No.3 dated 01-01-2021. The assessee now desires to withdraw his Appeal No.751/PUN/2017.

The Hon’ble ITAT may kindly accept the request of the assessee and pass necessary order as early as possible. A copy of Form No.3 is attached herewith.”

3. The ld. DR did not raise any objection to the withdrawal of the appeal filed by the assessee. As such, the assessee is permitted to withdraw the appeal.

4. In the result, the appeal is dismissed as ‘withdrawn’.
