14 September 2023I have a query regarding donation to a section 8 company, wherein the donor company (Pvt Ltd Co. & a LLP) has the same board of directors and shareholders as to a Donee Company (Section 8 company). Whether the donor company & LLP can avail deduction under section 80G?

To claim a deduction under Section 80G, obtaining the donation certificate (Form 10 BE) from the charitable institution or NGO to which the donation has been made is mandatory. It is important to ensure that the donee institution furnishes the statement of donation in Form 10BD and issues the certificate of donation in Form 10BE generated from the e-filing portal in a timely manner to avoid any fees or penalties.
In your case which Institute gets Form 10BE can claim deduction under 80G
