Tds-to be deducted on st also

Dear All,

Whether TDS to be deducted excluding Service Tax portion or including Service Tax portion.

Plz clarify me at the earliest.

Only in case of rent (sec 194I) tds is to be deducted excluding Service tax amount and on all other payments tds is to be deducted on amount including service tax.

TDS IS DEDUCTED ON GROSS AMOUNT i.e. (BASIC AMOUNT + SERVICE TAX) AND EXCEPTION TO THIS RULE IS SEC 194I WHICH MEANS THAT IN CASE OF RENT ONLY TDS IS TO BE DEDUCTED ON RENT AMOUNT EXCLUDING SERVICE TAX.
