Tds on payments made to nri

Dear All,

We are the Private Limited Co. We have made the payment to NRI (Germany)  for Hotel purchase.

Are we liable to make TDS ?? If yes, then please suggest the section and rate of TDS.

Please give ur valuable suggestions.
