22 April 2009Cars owned by the company and provided to its executives are got repaired at authorised service centres. Somestimes apart from normal repair, some parts are also repplaced by the service centre. The Centre raises its combined bill in the name of the Company. Kindly advise whether company should deduct TDS if annual payment is Rs. 5.0 lacs to one centre.

TDS should be deducted on the repair maintainance but TDS may not be deducted on the bills containing replacement of parts(if they are to be capitalized)

Mr. Shailendra,
Your company has to deduct TDS while making the payment to the service centre.
