As per section 248 (1) and section 248(2), the Company which are striked of by teh ROC are no longer in existence as the legal entity of the Company has been disolved and such Company are assumed to be wound up. Only those Companies which could not be striked off like vanishing Companies, Company which are delisted, Company against which the charge is pending or the order from the court is pending cannot be striken off. They need to be wound up subject to the provisions of Insolvency and Bankruptcy code.
