Dear Experts,

We dispatched the goods under ARE-1 without payment of duty dt. 07/07/2010, but still we have not receive the proof of export of the said consignment. What will happen next ? whether we have to pay the excise duty of the said consignment ?

if yes , then is there any solution for not to pay the excise duty ? pl. help.

Thanks in advance.

From where you are going to receive proof of export? You must be knowing whether the goods have been exported or not. If the goods could not be exported within 6 months, and likely to exported after sometime, you can revalidate the ARE-1 for another 6 months.

Dear Rajesh Sir,

Please define the process of Revalidation of an ARE-1.

Once goods are cleared on ARE-1, it is expected to be exported within 6 months. If export could not be completed in 6 months, further time can be allowed by bond accepting authority, which is called revalidation. Please refer to para 13.6 of Chapter 7 of CBEC Excise Manual for further detail.

Proof of Export not receive within 6 month

If proof of export not received within 6 months then   duty foregone on that export shold be debited with interest .
