FOR ATTENTION OF MEMBERS, STUDENTS

AND OTHER STAKE HOLDERS

Re: Invitation of views/suggestions for simplification and

rationalization of the provisions of the Chartered

Accountants Regulations, 1988.

As you are aware, the Institute of Chartered Accountants of India

(ICAI) was established on 1st July, 1949 for regulating the profession of

Chartered Accountants in India. The Chartered Accountants Act, 1949

provides for the framework/scheme of regulation of the profession. The

manner (including the procedure) in which such a regulation should be

operational had been dealt with in the Chartered Accountants Regulations

framed under the said Act. The Regulations currently in place, namely, The

Chartered Accountants Regulations, 1988 came in force on 1st June, 1988 and

since then number of amendments pertaining to the affairs of members,

students including examinees and examinations have been made therein,

from time to time, with the prior approval of the Central Government, as

required under the Chartered Accountants Act, 1949.

The said Act had been amended comprehensively in the year 2006 and

required consequential changes/amendments in the Regulations have also

been made since then.

Recently, the Council of the ICAI felt it imperative to undertake a

thorough and comprehensive review/rationalization of Regulations coupled

with the Directions issued by it from time to time for managing the affairs of

the Branches of Regional Councils set up all over the country (having regard

to the efflux of time, changes taken place in socio economic conditions of the

country in the last more than two decades) and for the purpose constituted a

Special Group under the Convenorship of CA. G. Ramaswamy, Vice-President

of the Institute, with the following Terms of Reference:-

1. To study and examine the provisions of existing Regulations,

Directions of Council regarding Functions of Branches of Regional

Councils and various decisions of Council/Executive Committee in

place, in light of experience gained and expectations of members,

students, Government/Regulators/Stake-holders and the like and

suggest suitable amendments/changes therein so as to make such

provisions not only more robust and effective, but also to make

them members/students friendly.

2. Any other suggestions, incidental, ancillary and related to the

above.

The Group, while considering the methodology to be adopted for

undertaking the onerous task and its accomplishment, felt that the exercise

being undertaken will not be effective and complete, unless it has with it the

views/suggestions/input of members, students including examinees and the

public at large.

Therefore, members, students and others are requested to kindly send

their views/suggestions in the light of either any difficulty experienced by

them or otherwise for consideration of the Group. The views/suggestions

It may be mentioned that since the present exercise is undertaken

after lapse of about two decades, the response, input and support of

members, students and public at large are of paramount relevance to provide

an effective and member-student friendly delivery system in place through

robust provisions. In other words, the need of the hour is simplification and

rationalization of regulatory framework relating to administration of day to

day affairs of members and students.

Thanks to Chandrakant Ambani for posting that announcement of ICAI.You're right we the PEII students should take the full oppurtunity.We"ll discuss that aspect as well here with our fellow students.Regarding Nitin's suggestion about terlephonic discussion,I feel it would be better to present our case through mail.If possible do send the mail ids.But first we have to get in touch with those functioning from Delhi because you've to approach the concerned officials in Delhi only.Give your views as to making suggestions to the Institute to simplification & rationalization of the CA Act with respect to the PEII students.

 Dear Sir/Madam,

First i wants to thanks to you for extending two more attempts for PE - 2 Students.
its really helpful to me as i have cleared my first Group with Exemption in Audit.and i am going to give my Group -2 in coming May 2010 Attempt.


SPECIAL PROBLEM FOR PE - 2 (GRADUATION BASED STUDENTS)
Its really Frustrating that we are at the age of 25 not able to start our articalship. and many of my friends joind CA with PE-1 or CPT are at the stage of completing there articalship and not yet cleared any one of the Group of PE-2/PCC.
and we have to satisfied with low amount of stipend at the age of 25-28. they can join Industries or any other well pay job during that period.i hope you will understand my problem.

      My mail is result of lots of family and social pressure.I will respect Institute Decisions.I hope institute will come up with positive Decision.

Dear Friend,
I understand the genuine problem being faced by students who have not yet cleared PE-II. This was the reason to facilitate students, the ICAI extended the time limit for PE-II, again and again.
We have to respect the ICAI’s decision. However, I will take up the matter to an appropriate level.

i think asking for increase in attempts will not work, not even asking for exemptions in articleship...for those people who work during this period,it would be better if some seniors post here some all possible things that should be said to ICAI

Thats what exactly i want to say asking for increasing the no.. of attempts or exemtion for articleship duration will not work.what  if institute ready for incrasing attempts or articlshp duration,but the passing rate were still remain the same..its of no use....So bttr ask for increasing the passing rate like as ipcc and pcc.....

why we have to Beg in frunt of Institute...we will show our performance...to pass...

Only fair deal is important for Starting of artical on basis of clear of one of the Group of PE II

i have an intuition that ICAI will have knowledge about the problem faced by pe2 student.... but we should not stop by this assumption....

first of all dear friends we should know wht we going to demand from icai, whether more attempts,exemption in articleship, or in the increase of passing ratio.

I think we are not going to win if we get more attempt , we need that peii students not get neglected by the icai as compared to pcc/ipcc. as we seeing the result in the past. the peii passing ratio is lower than other.

if we ask for reduction in articleship....for people who have work ex...then people will produce fake certificates of work ex....so it'll be rejected easily.

I think asking them for Increase in passing % is good idea..otherwise shift them to IPCC with addtional conditions...like those who have cleared any groups...asking them for exemtions in those paper...for 3 or 4 attempts...

..
