Is there any recent update about the Section 234 E of Income Tax Act.,?
Because, few of stays held on Section 234 E of Income Tax Act., by the courts.

Fees u/s 234E can not be waived by any means. It has to be paid compulsory. & it is not penalty

Late Fees can be waived off subject to certain conditions.

If fees are not levied u/s 234e, the deductor may not file the tds returns at all. How dept would than do the assessment? Hence the fees. Chances that it may be reduced due to stay granted by various High Courts.

Pooja, case laws are for particular case & for particular situation you can not apply one case law in other situation.
